Privacy Policy

1. Scope of This Policy

Merchant Mobile Connect (“we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with our website, SaaS platforms, including ApolloIQ Pro, mobile apps, AI tools, and related services (“Services”).

Our Services may include website and mobile app development, customer relationship management, AI voice and chat, text and email communications, automation, scheduling, online payments, courses, and membership management.

When we process information on behalf of a business, church, or other client, that client generally determines how the information is used. The client’s privacy policy and our agreement with that client govern that processing. Questions about information submitted to a client’s website, app, or messaging program should generally be directed to that client.

2. Information We Collect

Depending on the Services you use, we may collect:

  • •Contact and account information: Your name, organization, email address, telephone number, business address, login information, and communication preferences.
  • •Billing and transaction information: Billing contact details, subscription information, payment status, and transaction records. Payment processors handle payment credentials according to their own privacy and security practices.
  • •Client-provided information: Contact lists, appointment records, membership information, form submissions, uploaded files, and other information clients choose to store or process through the Services.
  • •Communications and AI interactions: Support requests, emails, text messages, chat conversations, AI prompts and responses, and call-related information. Where enabled and legally permitted, this may include call recordings, transcripts, and summaries.
  • •Usage and device information: IP address, browser type, operating system, device identifiers, pages visited, feature usage, timestamps, and diagnostic logs.
  • •Consent records: Communication preferences, opt-in dates and methods, disclosures presented at sign-up, and unsubscribe or consent-withdrawal requests.
  • •Connected service information: Information received from integrations you or your organization authorize, such as calendars, social media accounts, payment services, and other connected applications.

3. How We Use Information

We use information as necessary to:

  • •Create and administer accounts.
  • •Provide, configure, and maintain the Services.
  • •Build and support websites, mobile apps, and integrations.
  • •Process payments and manage subscriptions.
  • •Deliver requested messages, appointments, and automated workflows.

  • •Send marketing communications where permitted by law and consistent with your preferences.

We do not use information for materially different purposes without providing any notice and obtaining any consent required by applicable law.

4. When We Disclose Information

  • •Service providers: We may use hosting providers, software platforms, AI providers, communications carriers, payment processors, and support providers to perform services on our behalf. Access is limited to what is reasonably necessary for their services and subject to applicable contractual restrictions.
  • •Authorized integrations: We may transmit information to third-party services you or your organization choose to connect.
  • •Account administrators: Authorized administrators may access information associated with their organization’s account according to assigned permissions.
  • •Legal and security purposes: We may disclose information when required by law or reasonably necessary to address fraud, security threats, or protect legal rights.
  • •Business transactions: Information may be transferred in a merger, acquisition, or sale of business assets, subject to applicable law and continued privacy protections. Such a transaction does not authorize independent marketing use of mobile information or messaging consent records.
  • •At your direction: We may disclose information when you specifically request or authorize us to do so.

We do not sell personal information or provide it to third parties for their independent marketing purposes.

We may disclose information in the following circumstances, subject to the mobile messaging protections in Section 5:

5. Mobile Information and Text Messaging Consent

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent are excluded from all general information-sharing categories described in this Policy. We do not sell, rent, transfer, or share this information with third parties or affiliates for their own use, including their marketing or promotional purposes.

Limited processing by service providers that operate our messaging services, including messaging platforms and carriers, may be necessary to deliver messages, maintain consent records, prevent abuse, and fulfill legal obligations. These providers are not authorized to use that information for their own marketing.

Where legally required, we obtain consent before sending marketing text messages. Consent to marketing text messages is not a condition of purchase.

Message frequency varies by the program you join. Message and data rates may apply. You may reply STOP to unsubscribe or HELP for assistance where supported. You may also contact us using the details below. We honor other valid consent-withdrawal requests as required by law.

If you receive messages from one of our clients, contact that organization about its messaging program and privacy practices.

6. AI Voice, Chat, and Automation

When you interact with enabled AI features, information you submit may be processed by the software and AI providers supporting those features.

Depending on configuration, this may include conversation content, prompts, responses, recordings, transcripts, and appointment details. We use this information to provide the requested functionality, support the service, and address security or technical issues.

Provider retention and model-training practices depend on the specific provider, product, configuration, and applicable agreements. Contact us before submitting confidential or regulated information if you need details about a particular feature.

Call recording and transcription should be enabled only with legally required notices and consent. Clients are responsible for configuring their services appropriately and providing required disclosures to their users.

7. Cookies and Similar Technologies

Our website and Services may use cookies, local storage, and similar technologies to maintain sessions, remember preferences, support security, and understand usage.

You can manage cookies through browser settings and any cookie controls we provide. Disabling certain cookies may affect functionality.

Where required by law, we obtain consent before using nonessential tracking technologies and honor applicable opt-out preferences.

8. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain business records, resolve disputes, protect security, and meet legal obligations.

Retention depends on the type of information, account status, client instructions, provider capabilities, and applicable agreements.

After an account closes, information may be deleted or de-identified according to applicable retention practices. Some information may remain temporarily in backups or be retained for legal, billing, security, or consent-compliance purposes.

Clients should arrange any needed data exports before terminating their Services.

9. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Users should protect their credentials, limit account access to authorized individuals, and notify us promptly of suspected unauthorized activity.

10. Your Privacy Rights and Choices

Depending on your location and applicable law, you may have rights to:

  • •Request access to personal information we hold about you.
  • •Correct inaccurate information.
  • •Request deletion of personal information.
  • •Obtain a portable copy of certain information.
  • •Restrict or object to certain processing.
  • •Withdraw consent where processing relies on consent.
  • •Opt out of applicable marketing or other covered processing.
  • •Appeal a privacy request decision where applicable.

To submit a request, contact info@merchantmobileconnect.com. We may verify your identity before responding. Certain information may be retained where permitted or required by law.

We will not unlawfully discriminate against you for exercising applicable privacy rights.

If we process your information on behalf of a client, we may direct your request to that client or assist it in responding.

11. Communication Preferences

You may unsubscribe from marketing emails through the unsubscribe link provided in the message.

For text messages, follow the instructions in Section 5 or contact us directly.

Opting out of marketing does not prevent necessary account, billing, security, or service communications, subject to applicable law and channel-specific consent requirements.

12. Mobile App Permissions

Depending on the app and features you enable, a mobile app may request access to notifications, a camera, photos, a microphone, or location.

Permissions should relate to the functionality you choose to use. You can manage them through your device settings, although disabling a permission may limit the associated feature.

Client-branded apps may have separate privacy notices describing their specific collection and permissions.

13. Children’s Privacy

Our agency website and business account registration are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13 through those channels.

If you believe a child has provided personal information without appropriate authorization, contact us so we can investigate and take appropriate action.

Clients offering programs or apps to children must ensure their use of the Services complies with applicable children’s privacy requirements, including parental consent where required. Such uses require appropriate service configuration, agreements, and privacy disclosures.

14. Sensitive Information

Do not submit Social Security numbers, protected health information, financial account credentials, or other highly sensitive information through general contact forms, ordinary chat, or AI tools.

Processing regulated information requires confirmation that the specific service supports that use, appropriate safeguards, and any necessary written agreements.

15. International Processing

We are based in the United States. Our service providers may process information in the United States and other countries where they operate.

Where applicable law requires safeguards for international transfers, we will use appropriate transfer mechanisms and contractual protections.

16. Third-Party Websites and Services

Our Services may link to or integrate with third-party websites, app stores, payment services, and social platforms.

Their privacy practices are governed by their own policies. Review those policies before providing information or authorizing an integration.

17. Changes to This Privacy Policy

We may update this Policy to reflect changes in our Services, practices, or legal requirements. The updated version will show a revised effective date.

For material changes, we will provide additional notice and obtain consent where required by law.
